It's been on the state's law books for more than 30 years, but now the ban on the sale or promotion of sex toys in Texas has been overturned by a federal appeals court.
The 5th U.S. Circuit Court of Appeals ruled that the Texas law making it illegal to sell or promote obscene devices. That law carried a sentence as long as two years in jail. According to the court decision, the Texas law violates the right to privacy guaranteed under the 14th Amendment.
